Va. man charged with capital murder in 2009 slaying

LEESBURG, Va. (AP) — A Middleburg man is facing a possible death sentence after a grand jury indicted him on capital murder charges for the 2009 death of a former CIA contractor.

Twenty-six-year-old Anthony Roberts is the third person to face murder charges in the attack on William and Cynthia Bennett of Lansdowne. William Bennett was found dead with a cracked skull. Cynthia Bennett survived but suffered serious injuries. Roberts is charged with raping her.

Authorities have said the attack was random, and that Roberts and the others were gang members.

Two others have been sentenced to more than 40 years under plea deals requiring them to testify against Roberts.

Prosecutors announced Roberts' indictment Tuesday, but he was initially charged a few weeks after the attack and has been in custody on other charges.
