Saraia Collins was assaulted by a fellow Highland Park Elementary School student on May 8. She has not been back to school since the beating, which was caught on video.
"I'm afraid that they're going to bully and tease me again, " the 9-year-old said.
"I just want it to all stop. We all need to stand up together as a community, as administrators, as the school board-- together to bring this to a halt. We need to stop it. We can't keep letting it go on," said mother Tierra Holland.
A lawyer for the family says the school system created a climate that allowed bullying.
"The truth of the matter is she is scared to go back to school and I'm not sure how it is that they compensate her for that. She is scared to have interaction with other students. I'm not sure how they compensate her for that," said attorney Brian McDaniel.
A spokesperson for the school system told FOX 5 that appropriate action will be taken regarding the lawsuit.
