Woman in cake drop kicking incident accused of hitting ice cream worker

A woman accused of drop kicking a birthday cake at a Kroger is now charged with assault of an ice cream store employee.

Tricia Ann Kortes was accused of assault and battery at Ray's Ice Cream in Royal Oak on July 9, 2015.

FOX 2 learned that Kortes became belligerent after finding out the store was out of Mackinac Island Fudge and allegedly reached over the counter and hit the manager the head.

She was expected to turn herself today and is expected to be arraigned in the ice cream incident.

Kortes was accused of drop kicking a birthday cake at a Bloomfield Township Kroger last June.

Customers and employees told police they watched 46-year-old Tricia Ann Kortes not only drop kick the cake into the air, but also stomp on it and leave without paying. The store's manager says she was picking up a special order Superman v. Batman birthday cake, but was apparently not pleased with the way it turned out.

Employees said she went behind the counter to try and fix it herself but employees told her she could not be behind the counter. So she was infuriated and took the cake to the front of the counter and drop kicked it, employees said.

The cake and frosting went everywhere in the bakery department and the woman stormed out, knocking over a wet floor sign on her way out.

Because the cake was special order, her name and phone number on file at the store. Employees talked to the woman who said she was upset about the quality of the cake, but said the cake slipped out of her hand and she did not kick it.

A witness said she threw the cake on the floor, stepped on it several times, and yelled "They f***ing ruined my 7-year-old's birthday cake!"
